1. Introduction and Acceptance of Terms
These Terms of Service ("Terms") govern the use of educational services, facilities, communications, registrations, and related offerings provided by Harbourview Learning Centre ("Harbourview Learning Centre", "we", "us", or "our"), a school operating in Hong Kong.
By enrolling in, accessing, booking, or otherwise using any of our services, or by permitting a student to participate in our services, the student, parent, guardian, or other authorised representative ("you" or "your") agrees to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
Where the student is under 18 years of age, these Terms shall be accepted by a parent or legal guardian on the student’s behalf. The parent or guardian remains responsible for the student’s compliance with these Terms.
2. Scope of Services
Harbourview Learning Centre provides educational and student support services, which may include, without limitation:
- After-school tutoring;
- Homework support;
- Exam preparation classes;
- English language enrichment;
- Mathematics skills development; and
- Parent consultation sessions.
We may offer services in person, online, or through a blended format, depending on availability, programme design, and operational requirements. Specific class schedules, age groups, curriculum content, class sizes, fees, and service arrangements may vary and will be communicated separately.
We reserve the right to modify, suspend, or discontinue any service, class, programme, or session at any time, subject to applicable law and any pre-paid commitments already made to you.
3. User Obligations and Responsibilities
You agree to:
- Provide accurate, complete, and current information during registration and throughout the period of enrolment;
- Ensure that the student attends classes punctually and is prepared with the required materials;
- Comply with all centre rules, safety instructions, attendance requirements, and reasonable directions given by our staff;
- Ensure the student behaves respectfully toward staff, tutors, other students, and visitors;
- Not disrupt classes, damage property, or engage in bullying, harassment, discrimination, cheating, plagiarism, or any unlawful conduct;
- Notify us promptly of any medical condition, learning need, allergy, disability, behavioural concern, or other matter that may affect participation or safety;
- Collect the student on time after classes, unless alternative arrangements have been agreed in writing;
- Supervise the student appropriately before and after class where required;
- Use any online learning platforms or materials lawfully and only for their intended educational purpose; and
- Comply with all applicable laws and regulations, including those relating to child protection, safety, and intellectual property.
We may refuse admission, suspend participation, or terminate services where a student or parent/guardian acts in a manner that is unsafe, abusive, unlawful, disruptive, or materially breaches these Terms or our centre rules.
4. Payment Terms and Conditions
Fees, payment schedules, and any applicable charges will be communicated at the time of enrolment or booking. Unless otherwise stated, all fees are payable in Hong Kong dollars (HKD).
- Payment must be made by the due date specified on the invoice, registration form, or payment notice.
- We may require advance payment, deposits, or full payment before a student may commence or continue services.
- Failure to pay on time may result in suspension of services, withholding of class placement, or cancellation of enrolment.
- Any bank charges, card processing fees, or other payment-related costs imposed by third-party providers may be borne by you unless we state otherwise.
- We reserve the right to revise our fees from time to time. Fee changes will not affect services already paid for, unless otherwise agreed or required by law.
If any payment is overdue, we may charge reasonable administrative costs and interest to the extent permitted by applicable law. Nothing in these Terms limits any rights we may have to recover unpaid amounts.
5. Cancellation and Refund Policy
Cancellations, make-up classes, transfers, and refunds are subject to our then-current policy and any specific programme terms provided at enrolment. Unless otherwise stated in writing, the following general rules apply:
- Fees paid for completed classes, attended sessions, or used services are non-refundable.
- Requests to cancel enrolment or withdraw from a programme should be made in writing to our contact details above.
- Refunds, if any, may be processed only for unused portions of prepaid services and may be subject to administrative deductions to the extent permitted by law.
- Missed classes due to student absence, travel, illness, or personal reasons are generally not refundable and may not be eligible for make-up sessions unless we expressly agree otherwise.
- We may cancel or reschedule classes due to insufficient enrolment, staff availability, safety concerns, adverse weather, public health measures, or other operational reasons.
- If we cancel a class and cannot offer a reasonable alternative, we will provide a refund or credit for the unused portion of the prepaid fee, subject to applicable law and programme terms.
Any refund request must be supported by relevant documentation where reasonably required. Refund processing times may vary depending on the payment method used.
6. Liability Limitations
To the maximum extent permitted by the laws of Hong Kong, Harbourview Learning Centre, its directors, officers, employees, tutors, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive loss or damage, including loss of profits, loss of opportunity, loss of data, or reputational harm, arising out of or in connection with the use of our services.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for fraud, wilful misconduct, gross negligence, or death or personal injury caused by negligence to the extent such liability cannot be excluded under applicable law.
Subject to the foregoing, our total aggregate liability arising from or in connection with any service, event, or claim shall be limited to the amount paid by you for the specific service giving rise to the claim during the relevant period, or such other amount as may be required by law.
We do not guarantee any particular academic outcome, examination result, admission outcome, or improvement in performance, as results depend on multiple factors outside our control, including student effort, attendance, prior ability, and external assessment criteria.
7. Intellectual Property Rights
All teaching materials, worksheets, lesson plans, presentations, recordings, assessments, handouts, logos, trademarks, course outlines, and other content provided by or on behalf of Harbourview Learning Centre are owned by us or our licensors, unless otherwise stated.
- You may use our materials only for personal, non-commercial educational purposes in connection with our services.
- You must not copy, reproduce, distribute, publish, sell, modify, translate, upload, or share our materials without our prior written consent.
- Any unauthorised recording, photographing, scanning, or digital reproduction of classes or materials is prohibited unless we expressly permit it in writing.
- Any feedback, suggestions, or ideas you provide to us may be used by us without restriction, unless otherwise agreed in writing.
If you submit materials to us, you represent that you have the right to do so and grant us a non-exclusive, royalty-free licence to use such materials for the purpose of delivering and improving our services, subject to applicable law and our privacy obligations.
8. Data Protection and Privacy
We are committed to protecting personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong and other applicable laws. By using our services, you acknowledge that we may collect, use, store, transfer, and otherwise process personal data relating to students, parents, guardians, and other authorised contacts for legitimate educational, administrative, safety, communication, billing, and operational purposes.
Such data may include, without limitation:
- Identification and contact details;
- Student enrolment and attendance information;
- Academic progress and assessment records;
- Health, emergency, or support information provided voluntarily or as reasonably necessary;
- Payment and transaction records; and
- Communications with you and records of service use.
We may disclose personal data to staff, service providers, payment processors, IT vendors, or other third parties where necessary for service delivery, administration, legal compliance, safeguarding, or legitimate business purposes, subject to appropriate confidentiality and security measures.
You have rights in relation to your personal data under applicable law, including the right to request access to and correction of personal data, subject to statutory conditions and exemptions. Requests should be made in writing to our contact details above.
Where we use photographs, videos, or testimonials for promotional purposes, we will seek consent where required by law or where appropriate. You may withdraw consent where applicable, subject to legal and operational limitations.
9. Force Majeure
We shall not be liable for any delay, failure, or interruption in the performance of our obligations caused by events beyond our reasonable control, including but not limited to natural disasters, fire, flood, epidemic, pandemic, public health emergencies, government restrictions, acts of war, civil unrest, labour disputes, power outages, telecommunications failures, transport disruptions, or acts of third parties.
In such circumstances, we may suspend, reschedule, modify, or deliver services through alternative means, including online delivery where feasible. We will use reasonable efforts to minimise disruption and communicate any changes as soon as practicable.
10. Changes to Terms
We may update or revise these Terms from time to time to reflect changes in our services, operational practices, legal requirements, or other reasons. The updated Terms will take effect on the date specified in the revised version, or upon publication if no effective date is stated.
Where reasonably practicable, we will provide notice of material changes by email, website notice, or other appropriate means. Your continued use of our services after the effective date of any revised Terms constitutes acceptance of those changes.
11. Applicable Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
Any dispute, controversy, or claim arising out of or in connection with these Terms, including any question regarding their existence, validity, interpretation, performance, breach, or termination, shall be subject to the exclusive jurisdiction of the courts of Hong Kong, unless otherwise required by law.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, unenforceable, or contrary to applicable law by a court or competent authority, that provision shall be deemed severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Where possible, any invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the original intent and commercial purpose.
